Terms and conditions of sale
Subject of the contract
These General Conditions concern the purchase of products made remotely via telematic network from HDR Sas, located at via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE) – VAT No. 03256320619, owner of the website www.aloepluscaniegatti.it. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, regarding privacy protection, will be subject to the regulations of Law no. 675/96 and subsequent amendments.
Acceptance of the general terms of sale
The contract concluded between HDR Sas and the Customer is considered finalized upon acceptance of the order by HDR Sas. Such acceptance is deemed tacit. By placing an order through the various available methods, the Customer declares to have read all the information provided during the purchase process and to fully accept the general and payment conditions set forth below. If the Customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity), once the purchase procedure is completed, they will print or save an electronic copy and keep these general terms of sale, in compliance with Articles 3 and 4 of Legislative Decree 185/1999 on distance sales and, regarding privacy protection, will be subject to the regulations of Law no. 675/96 and subsequent amendments.
Any right of the Customer to compensation or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order.
Purchase methods
The Customer can only purchase products listed on the website www.aloepluscaniegatti.it. It is understood that the image accompanying the product description is purely illustrative and the product may differ from the photo shown. All supporting purchase information is to be considered as general informational material, not referring to the actual characteristics of a single product.
The correct receipt of the order is confirmed by HDR Sas via an email sent to the email address provided by the Customer. This confirmation message will include an ‘Order Number’ to be used in all further communications with HDR Sas. The message repeats all data entered by the Customer, who commits to verify its accuracy and promptly communicate any corrections according to the procedures described in this document. In case of non-acceptance of the order, HDR Sas guarantees timely communication to the Customer. Right of withdrawal
According to Legislative Decree 206/2005, if the customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity, or who does not provide a VAT number reference in the order form to HDR Sas), they have the right to withdraw from the purchase contract for any reason, without needing to provide explanations and without any penalty, except as indicated below. To exercise this right, the customer must send a communication to HDR Sas within 14 working days from the date of receipt of the goods. This communication can be sent by email to supporto@hdrcompany.com, by fax to 0823/944738, or by mail addressed to HDR Sas via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE). Upon receipt of the withdrawal communication, HDR Sas will promptly provide the customer with instructions on how to return the goods, which must be received by HDR Sas within 14 days of authorization.
The right of withdrawal is subject to the following conditions:
– the right applies to the product purchased in its entirety; it is not possible to withdraw only part of the purchased product;
– the purchased item must be intact and returned in its original packaging, complete in all parts; in all cases, avoid placing labels or adhesive tapes directly on the original product packaging;
– by law, shipping costs related to the return of the goods are the responsibility of the customer;
– shipping, until confirmation of receipt at our warehouse, is entirely the customer’s responsibility;
– in case of damage to the goods during transport, HDR Sas will notify the customer of the event (within 5 working days of receipt at its warehouse) to allow the customer to promptly file a claim against the chosen courier and obtain reimbursement of the product value (if insured); in this case, the product will be made available to the customer for return, simultaneously canceling the withdrawal request;
– HDR Sas is not responsible in any way for damage, theft, or loss of goods returned via uninsured shipments;
– upon arrival at the warehouse, the product will be inspected for any damage or tampering not caused by transport. If the original packaging and/or wrapping is damaged, HDR Sas will withhold a percentage, not exceeding 10%, from the refund as a contribution to restoration costs. Subject to any restoration costs for confirmed damage to the original packaging, HDR Sas will refund the amount already paid to the customer as soon as possible and in any case within 30 days from the withdrawal request, by reversing the charge on the credit card or by bank transfer. In the latter case, the customer must promptly provide the bank details for the refund (ABI code – CAB – bank account of the invoice holder).
The right of withdrawal is completely forfeited if the essential condition of the product’s integrity (packaging and/or contents) is not met, in cases where HDR Sas finds:
– the absence of the external packaging and/or original internal wrapping;
– damage to the product for reasons other than transport.
In case of forfeiture of the right of withdrawal, HDR Sas will return the purchased goods to the sender, charging the shipping costs to them.
Satisfaction or refund guarantee
Products marked with the “satisfaction or refund” label are covered by a special guarantee offered exclusively by HDR to its customers. The customer who purchases the product, within 30 working days from the date of receipt of the goods, if not satisfied with the quality of the products, can return the original packaging, even if empty, by mail addressed to: HDR Sas via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE). The guarantee is valid only for products ordered for the first time and not for reorders. If the return concerns multiple pieces of the same product, only one empty package can be returned; the other products must be intact.
Force majeure
Neither Party shall be held responsible for total or partial non-fulfillment of obligations arising from this contract if such non-fulfillment is caused by a case of force majeure. Force majeure events are those that meet the criteria established by case law. The Party invoking force majeure must notify the other Party within five working days from the occurrence or threat of such event. The Parties agree to promptly find an agreement to jointly determine how to execute the order during the force majeure period.

Any complaints must be addressed to HDR Sas by sending an email to supporto@hdrcompany.com, by phone at 0823.944738, or by mail addressed to HDR Sas via Papa Giovanni XXIII, 11 – 81014 Capriati a Volturno (CE). The sales contract between the Customer and HDR Sas is considered concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from this distance sales contract, if the Customer is a consumer, jurisdiction lies with the court of their municipality of residence; in all other cases, jurisdiction is exclusively with the Court of Isernia.
